These Terms of Service (“Terms”) govern your use of maplenorthit.com and any products or services you purchase from us. By using this site or buying anything from us, you agree to these Terms. If you do not agree, do not use the site or buy our products.
“We,” “us,” and “our” mean Maple North IT, a sole proprietorship registered in British Columbia, Canada. “You” means the individual or business using the site or buying our products.
1. What We Sell
We sell two categories of products and services:
- Compliance Kits and digital downloads: educational templates, checklists, and self-assessment workbooks delivered as ZIP files containing PDF, DOCX, and XLSX documents.
- Consulting services: IT audits, migration planning, and advisory retainers delivered through scheduled engagements with custom proposals.
Specific terms for consulting engagements are documented in the engagement letter we send after a scoping call. Where the engagement letter conflicts with these Terms, the engagement letter governs that specific engagement.
2. Educational Purpose, Not Legal Advice
Our compliance kits are educational templates based on publicly available information about specific privacy and data protection laws. They are not legal advice. We are an IT consultancy, not a law firm. Use of our products does not create a solicitor-client or attorney-client relationship.
Laws change. The contents of our products reflect publicly available information at the time of publication. You are responsible for verifying current requirements with qualified legal counsel in your jurisdiction before relying on any template, checklist, or recommendation.
We do not warrant that the templates fully comply with the law in your specific situation. Every business is different, and compliance depends on how the law applies to your specific operations.
3. License to Use Our Products
When you purchase a compliance kit, you receive a non-exclusive, non-transferable license for single-business use. This means:
You may:
- Use and modify the templates for your own business
- Share completed, customized documents with your staff, customers, and advisors
- Adapt the structure to fit your operations
You may not:
- Resell or redistribute the kit or its raw contents
- Share the unmodified templates with other businesses
- Publish the kit’s contents publicly
- Use the kit to create a competing product
- Remove the “Licensed to” watermark or copyright notices
We retain all intellectual property rights in our products. The license terminates automatically if you breach it.
4. Pricing and Payment
All prices on our website are listed in the currency shown next to the price. Payment is processed by Stripe. Prices may change at any time, but the price you see at checkout is the price you pay for that specific purchase.
For consulting services, the price is set in the proposal we send after the scoping call. The proposal is the binding price for that specific engagement.
5. Refunds
Compliance kits and digital downloads are non-refundable once payment is processed and the download link is delivered. Because these are digital goods that you can keep and use immediately, all sales are final. By completing a purchase, you acknowledge that you are losing the right of withdrawal that may apply to consumer purchases under your local law.
We may grant refunds at our sole discretion in exceptional circumstances (e.g. duplicate purchase, technical inability to download, clear error on our part). Email info@maplenorthit.com within 7 days of purchase to inquire.
Consulting service refunds are governed by the engagement letter for each project. Our standard policy is documented at the refund policy page.
6. Disclaimers
Our products and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our products will meet your specific requirements, that they will be uninterrupted or error-free, or that any defects will be corrected.
Free tools provided on this site (domain checker, password checker, business exposure scanner) are offered for informational purposes only. They use third-party data sources and may produce inaccurate or incomplete results. We are not responsible for any decision you make based on the output of a free tool.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from your use of our products or services shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not fully apply to you.
8. Indemnification
You agree to indemnify and hold harmless Maple North IT and its owner from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our products, your violation of these Terms, or your violation of any applicable law.
9. Acceptable Use
You agree not to:
- Use our products for any illegal purpose
- Attempt to reverse-engineer, decompile, or otherwise extract source code
- Use our free tools to attack or scan systems you do not own or have permission to scan
- Submit false or misleading information through our forms
- Attempt to gain unauthorized access to our systems
- Send spam, malware, or harmful content through any of our forms
10. Intellectual Property
All content on maplenorthit.com — including text, graphics, logos, the maple leaf design, and the structure of our products — is owned by Maple North IT or our licensors and is protected by copyright, trademark, and other laws.
11. Third-Party Links and Services
Our site may contain links to third-party websites or reference third-party services (e.g. regulator websites, software vendors). We are not responsible for the content, policies, or practices of any third party.
12. Termination
We may suspend or terminate your access to our products or services at any time if you violate these Terms. Termination does not entitle you to a refund of any amounts already paid.
13. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our products will be resolved in the courts of British Columbia, Canada, and you consent to the jurisdiction of those courts.
If you are a consumer in a jurisdiction with mandatory consumer protection laws (e.g. the European Union), nothing in these Terms removes your statutory rights under those laws.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on this page. Your continued use of the site or purchase of products after a change means you accept the updated Terms.
